1. Acceptance of Terms

By accessing or using the Infiforge service, website, or applications, you agree to be bound by these Terms of Service. If you do not agree to all the terms, do not use the service. Infiforge is operated by Infiforge ("we", "us", or "our").

2. Description of Service

Infiforge is a software company that builds and operates software products and technological solutions across web, mobile, and desktop platforms. Our services include custom software development, product partnerships, technical support retainers, and the operation of our own products. The Infiforge platform provides shared infrastructure (authentication, authorization, real-time communication, and data services) used across all products.

3. User Accounts and Identity

To use Infiforge, you must create an identity. You are responsible for maintaining the confidentiality of your authentication methods (including the device on which your passkeys live) and for all activities that occur under your identity. You must provide accurate, current, and complete account information. You may not use another person's identity without permission.

4. Acceptable Use

You agree to use Infiforge only for lawful purposes and in accordance with these terms. Prohibited activities include:

• Using the service to violate any applicable law or regulation
• Using the service to transmit malicious software, engage in hacking, or conduct unauthorized network attacks
• Using the service to distribute child sexual abuse material or any illegal content
• Using the service to infringe upon intellectual property rights
• Attempting to disrupt, degrade, or impair the Infiforge infrastructure
• Creating identities for the purpose of evading account termination or access control
• Reselling or commercially exploiting the service without authorization

5. Authentication and Security

Infiforge is a security service, and you agree to help keep it secure. You agree not to share or disclose your magic links, one-time passcodes, or passkey credentials with others. You agree to promptly notify us if you believe your identity has been compromised. Infiforge is not liable for losses arising from your failure to safeguard your authentication methods.

6. Privacy and Data

Infiforge's data practices are described in our Privacy Policy. We collect the minimum information necessary to provide the service and we never sell your data. Connected services receive only the identity attributes and scopes you explicitly approve.

7. Payment and Billing

Fixed-scope projects are billed according to the agreed statement of work. Retainer engagements (product partnerships and support retainers) are billed monthly or annually as selected at the start of the engagement. Payments are processed by third-party payment processors. Fees are non-refundable except as provided in our refund policy. We may change pricing with 30 days notice; price changes do not affect current billing cycles.

8. Refund Policy

Monthly retainer engagements may be cancelled with 30 days written notice. If you are not satisfied within the first 30 days of a new engagement, contact us for a full refund of fees paid in that period. Cancellations after 30 days take effect at the end of the current billing period and are not eligible for a prorated refund.

9. Intellectual Property

The core Infiforge authentication and authorization libraries are open source and licensed under the AGPLv3 license. The Infiforge name, logo, and brand assets are trademarks of Infiforge and may not be used without permission. The source code is available on GitHub.

10. Limitation of Liability

Infiforge is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied. We are not liable for any damages arising from your use of the service, including but not limited to direct, indirect, incidental, consequential, or punitive damages. In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim.

11. Service Availability

We strive for high availability and offer uptime guarantees on paid plans, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or suspend service temporarily with reasonable notice. We are not liable for any losses resulting from service unavailability.

12. Termination

We may suspend or terminate your identity if you violate these terms, engage in illegal activity, or if required by law. You may delete your identity at any time from your account settings or by contacting support. Upon deletion, your data will be removed in accordance with our Privacy Policy.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email and through the Infiforge application. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the jurisdiction in which Infiforge is incorporated, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service will be resolved in the courts of that jurisdiction.
